Digital Millennium Copyright Act Notice and Takedown Policy

1. Introduction

Drengskapur LLC ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), codified at 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using our Service that are reported to our Designated Copyright Agent.

This policy applies to LawForge and all related services operated by Drengskapur LLC.

2. Designated Copyright Agent

Our Designated Agent for receiving notifications of claimed infringement under the DMCA is:

DMCA Agent
Drengskapur LLC

Email: dmca@lawforge.io

This contact information is registered with the U.S. Copyright Office DMCA Designated Agent Directory.

3. Filing a DMCA Takedown Notice

If you believe that content available through our Service infringes your copyright, you may submit a written notification to our Designated Agent containing the following information required by 17 U.S.C. § 512(c)(3):

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

Required Elements

  1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL or other specific location)
  4. Contact information for the complaining party, including name, address, telephone number, and email address
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

How to Submit

Send your takedown notice to:

4. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent containing the following information required by 17 U.S.C. § 512(g)(3):

  1. Physical or electronic signature of the subscriber
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled
  3. A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
  4. The subscriber's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located (or if outside the United States, any judicial district in which we may be found), and that the subscriber will accept service of process from the person who provided the original notification or an agent of such person

Counter-Notice Process

Upon receipt of a valid counter-notification, we will:

  • Promptly provide the original complainant with a copy of the counter-notification
  • Inform the complainant that we will replace the removed material or cease disabling access to it in 10 business days
  • Replace the removed material or cease disabling access to it within 10-14 business days following receipt of the counter-notification, unless our Designated Agent receives notice from the complainant that they have filed a court action seeking to restrain the subscriber from engaging in infringing activity

5. Repeat Infringer Policy

In accordance with Section 512(i) of the DMCA, we have adopted and reasonably implemented a policy that provides for the termination of users who are repeat infringers in appropriate circumstances. As established in BMG Rights Management (US) LLC v. Cox Communications, Inc., 881 F.3d 293 (4th Cir. 2018), a repeat infringer policy must be actually enforced, not merely a paper policy.

We reserve the right to terminate the accounts of users who we determine, in our sole discretion, to be "repeat infringers." A repeat infringer includes, but is not limited to:

  • Users who have been the subject of more than two valid DMCA takedown notices
  • Users who have had content removed more than twice for any reason related to copyright infringement
  • Users who we believe are using the Service to repeatedly or flagrantly infringe copyrights

Consistent with Ellison v. Robertson, 357 F.3d 1072 (9th Cir. 2004), we maintain functional notification channels to ensure DMCA notices are received and processed. Terminated accounts are not reinstated.

6. Safe Harbor and Knowledge Standard

We operate under the safe harbor provisions of 17 U.S.C. § 512(c) for online service providers. Consistent with controlling case law, we apply the following standards:

Knowledge Standard

As established in Viacom International, Inc. v. YouTube, Inc., 676 F.3d 19 (2d Cir. 2012), general awareness that infringing material may exist on our platform is insufficient to constitute "red flag" knowledge. We respond to specific notices of infringement but are not required to proactively monitor all content. See also UMG Recordings, Inc. v. Shelter Capital Partners LLC, 718 F.3d 1006 (9th Cir. 2013).

Expeditious Removal

Upon receiving a valid DMCA takedown notice, we will act expeditiously to remove or disable access to the allegedly infringing material. Consistent with Capitol Records, LLC v. Vimeo, LLC, 826 F.3d 78 (2d Cir. 2016), our content review activities do not forfeit safe harbor protection.

7. Important Notes

We do not claim copyright over these public domain materials.

Third-Party Content

Some content accessible through our Service may be provided by or sourced from third parties. We are not responsible for the accuracy, legality, or appropriateness of such third-party content. If you believe third-party content infringes your copyright, please follow the procedures outlined above.

This policy is provided for informational purposes only and does not constitute legal advice. If you have questions about copyright law or the DMCA, please consult a qualified attorney.
